Broker Opinion of Value Expert Witness in Tennessee

The thing under attack in these cases is a broker's opinion of value — a BPO or BOV someone prepared, and now everyone is fighting about it — so the case is really about methodology. I review whether that opinion was built the way a competent Tennessee broker would build it, for litigation, lender, and matrimonial matters.

This page covers a focused service. For the broader editorial practice area, see Expert Witness in Tennessee.

It comes down to methodology

A BOV or BPO dispute turns on how the opinion was made: comparable selection, the adjustments, how market conditions were handled, and whether the broker had a defensible basis for the conclusion. My opinion explains what a competent Tennessee broker should have done, and where the contested one departed from it. The cases are lender litigation over REO, foreclosure, or loss-mitigation BPOs; divorce cases where a BOV drove equitable distribution; partition actions; and transactions where a broker's value opinion is now in dispute.

When counsel needs this expert

These come in pre-designation to pressure-test the BOV theory, in rebuttal of an opposing broker's or appraiser's report, or when the broker who authored the original BOV is unavailable or will not engage. I work from the contested BOV and the underlying file, confirm scope on a short call, and deliver the report, deposition, and testimony as needed — hourly, against a case-sized retainer.
